Please read these Terms and Conditions ("Terms") carefully before using the Spatial Player Pro mobile application (the "App") operated by threesixty.at GmbH ("we", "us", or "our").
Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.
By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App.
1. Use of the App
The App is intended for professional, non-commercial use by individual users and businesses.
- You must be at least 16+ years old to use this App.
- You are responsible for maintaining the confidentiality of your account and password, if applicable.
- You agree not to use the App for any unlawful purpose or in any way that could damage, disable, overburden, or impair the App.
2. Subscriptions and Payments
Certain features of the App may require a subscription.
- All payments are processed through Apple's payment system and revenuecat.
- Subscription fees and terms are clearly displayed before you complete a purchase.
- You can manage and cancel your subscription through your Apple ID account settings.
3. Intellectual Property
The App, including but not limited to its software, design, text, graphics, and all content, is the exclusive property of threesixty.at GmbH.
- All rights, title, and interest in and to the App and its content are and will remain our exclusive property and that of our licensors.
- You are granted a limited, non-exclusive, non-transferable, and revocable license to use the App for its intended purpose, subject to these Terms.
- You may not reproduce, distribute, modify, create derivative works of, publicly display, or transmit any of the material in the App.
4. Prohibited Uses
You agree not to:
- Use the App or its content for any unauthorized commercial purpose.
- Copy, distribute, transmit, broadcast, or exploit any content from the App without our written consent.
- Attempt to decompile, reverse engineer, disassemble, or hack the App.
5. Limitation of Liability
In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, data, or goodwill arising from your use of or inability to use the App.
6. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including violation of these Terms. Upon termination, your right to use the App will immediately cease.
7. Disclaimer of Warranties
The App is provided "as is" and "as available," without any warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted or error-free.
8. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, including legal fees, arising out of your misuse of the App, violation of these Terms, or breach of any representations made herein.
9. Severability
If any provision of these Terms is deemed unenforceable or invalid, it will be modified to reflect the intended purpose while the remaining provisions will continue in full force.
10. Entire Agreement
These Terms constitute the entire agreement between you and us regarding your use of the App and supersede all prior agreements.
11. Content Updates
We reserve the right to add, modify, or remove content from the App at any time without notice.
12. User Responsibilities
You are responsible for ensuring that your use of the App complies with applicable laws and regulations. You agree not to interfere with the App's functionality or network.
13. Technical Requirements
The App is optimized for use with the Apple Vision Pro device. While the App may operate on other configurations, full functionality and performance are not guaranteed on unsupported setups.
14. Changes to Terms
We reserve the right to modify these Terms at our discretion. Changes will be posted on this page, and continued use of the App constitutes acceptance of any modified terms.
15. Governing Law
These Terms are governed by the laws of Austria, without regard to conflict of law provisions.
